TERMS & CONDITIONS

1. STM's mission is to discover and develop talent uninto working models, actors and singers. It is the responsibility of the user to abide by this agreement and site guidelines. stmmodels.com uses various third party payment systems; each user is responsible to review and abide by the rules of those systems.

2. There are several key differentiators between stmmodels.com and other sites. Other sites seek to exploit the models and are either commercial or semi commercial in nature. stmmodels.com provides free access to the community and is constantly adding features to the site that continue to add value to the users of the site.

3. Disclaimer: The Service and the Sites contain information, facts and opinions from various individuals and organizations. THE SERVICE AND THE SITES ARE PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES WHICH ARE IMPOSED BY AND INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION UNDER THE LAWS APPLICABLE TO THIS AGREEMENT. NEITHER GREEN MONKEYS TALENT GROUP, INC., My ModelHousing.com., Graphic Company, LLC. NOR ITS AFFILIATES ENDORSE OR ARE RESPONSIBLE FOR THE ACCURACY OR RELIABILITY OF ANY OPINION, ADVICE OR STATEMENT ON THE SERVICE OR THE SITES.

5. Your use of the Service and the Sites is at your own risk. NEITHER stmmodels.com, NOR mymodelhousing.com, NOR ANY OF ITS SUBSIDIARIES, DIVISIONS, AFFILIATES, AGENTS, REPRESENTATIVES OR LICENSORS SHALL BE LIABLE TO YOU OR ANYONE ELSE FOR ANY LOSS OR INJURY OR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR SIMILAR DAMAGES ARISING OUT OF YOUR ACCESS OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE SERVICE AND THE SITES AND THE INFORMATION AVAILABLE ON THE SERVICE AND THE SITES OR ARISING OUT OF ANY ACTION TAKEN IN RESPONSE TO OR AS A RESULT OF ANY INFORMATION AVAILABLE ON THE SERVICE AND THE SITES. YOU HEREBY WAIVE ANY AND ALL CLAIMS AGAINST STMMODELS.COM, OR GREEN MONKEYS TALENT GROUP AND ITS SUBSIDIARIES, DIVISIONS, AFFILIATES, AGENTS, REPRESENTATIVES AND LICENSORS ARISING OUT OF YOUR USE OF THE SERVICE AND THE SITES AND THE INFORMATION AVAILABLE THEREON.

6. Any communication or material you post or transmit to the Service and/or the Sites is, and will be treated as, non-confidential and non-proprietary. You assume full responsibility for anything you post or transmit, and you grant stmmodels.com and its affiliates the right to edit, copy, publish and distribute any information or content you transmit for any purpose.

7. The Promotion and Recruitment of Escorts, Escort Services, Personal Companions, (etc.) are contrary to the purposes of stmmodels.com, and will not be tolerated in any fashion.

8. Stmmodels.com does not support bandwidth theft, the linking of images from stmmodels.com to other sites, or the misuse of links from Other sites to stmmodels.com. Anyone found linking images from stmmodels.com to other sites, copying content from stmmodels.com, or inappropriately linking to stmmodels.com (to increase their views - through use of hidden frames, or using programs to artificially raise page views etc.) will result in permanent REMOVAL from stmmodels.com without notification and may necessitate the notification of the appropriate State and/or Federal authorities.

9. As a member of stmmodels.com - you will receive regular email updates and will be contacted by other system members seeking to work with you, and you will receive occasional email from the stmmodels.com. As new features or member programs and promotions are developed and launched you will be informed via the postings to the site and also by email. We endeavor to limit email contact as much as possible from the system administrators, however when email is sent and returned with an email bad address, we will attempt to locate a correct address from any linked web site, and failing that your portfolio will be disabled (if you discover your portfolio has been disabled because of bad contact information, please contact us with the correct information and we will re-activate your portfolio.

10. This User Agreement and any disputes arising out of or related to the Service and the Sites shall be governed by, and construed and enforced in accordance with, the laws of the State of Florida. By your usage of, or your posting to, this site constitutes your agreement to, but not limited to, the current conditions listed in this agreement.

11. Stmmodels.com is not intended for users under the age of 13. If you are 13 years or younger please do not submit a portfolio or any personal information. If you are a parent, or a legal guardian of a model 13 years or younger, ensure that you enter and approve all information, and that your email address and contact information is used at all times.

13. Violation of these Terms and Conditions will cause your membership to be terminated without a refund.

PHOTOSHOOT PAYMENT AND CANCELLATION AGREEMENT

TERMS & CONDITIONS

1. The buyer by making an online credit card photo shoot deposit with the seller (ST Management/Vaska Photography/Green Monkeys Talent Group) states, acknowledges and understands:

2. The photography schedule and selected methodology are designed to accomplish the goals and wishes of the buyer in a manner enjoyed by all parties. Buyer and seller agree that cheerful cooperation and punctuality are therefore essential to that purpose. Shooting commences at the scheduled start time.

3. That a non-refundable reservation deposit is required.

4. That no guarantees, expressed or implied, are made that the photo shoot will meet all of the buyer's expectations, specifically regarding the shooting area chosen by the seller, weather conditions or look of finished photographs.

5. That they will be shooting in either a studio, in the Miramar area, or another area chosen by the seller.

6. That the seller has sole priority over the area chosen to shoot which is determined by the weather conditions, which would make shooting outside dangerous.

7. That the reservation deposit is a non-refundable partial payment and commitment for the reservation activity being reserved.

8. That there are no refunds for a reservation deposit cancellation made by the buyer for any reasons or under any circumstances.

9. That there are no refunds for any reservation changes made in the itinerary while shooting.

10. That there are no refunds or credit applied for a reservation deposit cancellation made for a third person for any reasons or under any circumstances.

11. That the buyer knows, understands and accepts the total cost for the reservation activity the reservation deposit is being made for.

12. That the seller does not offer a rain check on any of their photo shoots. The seller has no control over the weather and therefore cannot be responsible for the disruption of the buyer's photo shoot due to weather conditions.

13. That the buyer by making a credit card reservation deposit states full knowledge and acceptance of the terms and conditions of the reservation deposit cancellation policy.

14. That the buyer does waive his credit card rights to dispute or cancel the credit card reservation deposit made.

15. The total amount is to be paid, in full, thirty (30) days after the execution of this Payment Agreement.

16. Attendance to rescheduling of appointments is the sole responsibility of the buyer. Failure to attend a scheduled photo shoot during the designated period does not relieve the buyer’s obligation of this contract.

17. There is a fee of $50.00 (Fifty US Dollars) added for late payments, $25.00 (Twenty Five US Dollars) for bounced checks and 3% + $0.30 per transaction for Credit Card payments.

18. Any delay on the part of seller in taking action under the terms of this contract shall not be deemed a waiver of these fees.

19. Should your account become more than 30 days past invoicing, you may be contacted by sller’s Collections Department. They may contact you by phone, email or mail to remind you of the status of your account, 60 days after invoicing, your account will be reported to national credit bureaus, where it may begin to affect your credit.

20. That the buyer agrees to pay all costs (interest charges, late fees, collection costs, and possibly court costs and attorney fees) associated with the collection of any monies owed, or enforcing this contract in the event that the buyer fails to pay

21. That all questions of law in any action based upon any claim of breach of this agreement shall be determined in accordance with the laws of the State of Florida as existing at the time of such action. Any action brought by either party based on any claim arising under or as a result of the contract or based on the photoshoot of which it is a part, shall be brought in a court of competent jurisdiction in Broward County, Florida.

REFUND POLICY

1. That there is a reservation deposit cancellation grace period of 3 (three) business days after payment is made in which a refund will be made less a 10% administration fee.

2. That the cancellation shall be made by phone (305) 829-8315 and by mail to:

3. A full or partial refund will be made to a pre-paid party who was unable to shoot due only to seller’s fault under these conditions:

(i) Photographic equipment breakdown.
(ii) Photographer experiences illness, family crisis or other emergency.

4. The buyer shall also be responsible for payment for any seller’s materials charges incurred up to time of cancellation.

5. No refunds are given to a pre-paid party or someone in the party that can't shoot for some reason on any part or all of the days they have reserved.

6. No refunds are given to a pre-paid party or someone in the party for any unused pre-paid services included in the photoshoot package or any changes made in the itinerary while here.

RESCHEDULE POLICY

1. If the buyer needs to reschedule a photo shoot, it's no problem as long as you give us adequate notice. If, however, the buyer notifys the seller less than five business days before the photo shoot (a "late-reschedule"), or simply do not show up, you lose the right to to shoot.

2. A $100 (One Hundred US Dollars) first time rescheduling fee will apply.

3. In addition, if the buyer have late-rescheduled and then chosen another date for the photo shoot, the buyer may not late-reschedule that replacement photo shoot without forfeiting the original fees entirely and having to pay a $200 (two Hundred US Dollars) second time rescheduling fee. To summarize the reschedule policy in plain English: you can reschedule once, but not twice.

4. The buyer will not be able to reschedule the photoshoot three times, the buyer will lose the right to shoot.

5. After 5 months from the date of the first payment all deposits will be lost, resulting in a total cancellation of the photo shoot.

We reserve the right to change and modify these rules as appropriate and without notice.
